    FBI Director James Comey hit the nail on the head. He said videos of police killing black men is driving a narrative; "biased police are killing black men at epidemic rates." Comey added "It's a narrative given force by the awesome power of human empathy."

     But Comey notes there is no way to know if the number of black, brown or white people being shot by police is "up, down or sideways over the last three, five or 10 years." There is no national data base or tracking of people killed by cops.

     This writer finds that inexcusable in this age of data and algorithmic analysis. The Associated Press reports the FBI is moving forward with plans to establish a national data base on police use of force. In the meantime I wonder why, as a gesture of public service, police departments don't post their own internal data on use of weapons, lethal and otherwise?

THE BLOODY NRA

     In a parallel world where the morality of the NRA rules human hearts instead of Judeo-Christian values or those of other faith systems and beliefs, Wayne Lapierre would be gunned down by an AR 15.  In this world Lapierre has been an accomplice in the gunning down of innocent men, women and children. 

     The NRA and every member of Congress or a state legislature who has not advocated or voted to ban or restrict sales of the AR 15 have the blood of Orlando, Newtown, Auora and San Bernadino on their hands. The bullshit machine of the gun manufacturing and sales industry and the NRA has tried to sell this nation on the "sporting, hunting and self defense" qualities of the AR 15, a civilian model of the M 16 military rifle. The truth behind the fraud is greed, the sales of a gun.

     With federal trainers, ATF and FBI agents, local and state law enforcement personnel and US Army weapons instructors I have used AR 15s and many other weapons and handguns and with proficiency. There is no sound reason the AR 15 should be in civilian hands. AR 15s are designed to kill and the semi automatic nature of such weapons can be easily turned into rapid fire purveyors of death. Anyone who tells you anything else is either a liar, coward or someone who needs to prove masculinity or feminine macho with a gun.

     There are better hunting weapons. There are other weapons that require greater skill and mastery for sport and competitive shooting. There are plenty of other weapons that could be used for self defense-but God help us if we descend to the absurd theory being advocated that if more people are armed there would be fewer victims of mass shootings.

      The issues of gun safety, registration, control and all the peripheral arguments aside, the sale of assault weapons to the public is simply stupid and dangerous. Not to do something about it only moves us closer to that parallel world.

BOYCOTT JUSTIN?  

       When Justin Baldwin owned and managed the Justin Winery it was a place of quality, sustainability and a prestige label in the Paso Robles appellation. The flag ship Isosceles was an expensive wine but award winning and well respected. How far Justin has tumbled since Mr. Baldwin sold the operation to the Wonderful group owned by Stewart and Lynda Resnick the people behind POM Wonderful and Fiji Water and other enterprises.

        Presently San Luis Obispo County is investigating the practices of Justin winery. After a couple of years of complaints from the family-like Paso Robles wine industry, Justin is being seen in an interesting light.  A couple of years ago people complained that Justin had begun cutting revered California Live Oak trees, in droves. During the height of the drought Justin began clearing land and planting new vines. And they were said to be over irrigating. Many shook their heads.

        Aside from staff departures, the destruction of a beloved rose garden, they increased the volume of wine made. Under Baldwin the label found a level of case production that assured the quality people expected. That changed. Californians, familiar with Justin, found the wine on shelves and restaurants as far as Florida, where the once vaunted wine tasted nothing like the old limited quality product. 

      I pass this along and label it as gossip-I cannot prove the  veracity though anecdotally this has gained wide circulation in the local wine industry-where Baldwin produced something like 200 thousand cases a year, the Resnick regime is trying to push it to 1 million or more. They do sell a lot of pomegranate juice and bottled water, but a high quality wine is different. Baldwin loved wine and winemaking as do most of the Paso winemakers. It appears the new Justin is simply the manufacture of a commodity in pursuit of more sales.

      In the meantime they are being investigated for killing many prized California Live Oak-something you can not do-scraping hillsides and lying to the county about their intentions. They display the arrogance of a "one percenter" in a community known for friendly, cooperative, environmentally sensitive practices where there is a devotion to quality wine. We know people who are dropping their membership. Others are talking about a boycott. And the local government may have sanctions in store for a bad neighbor. It's my take the Resnick operation would be more at home in Napa.

FIGHTING WINTER-PRIVACY AND FREEDOM-RAPE AND FOOTBALL

FOR THE WINTER WEARY

     This post offers a few scenes for those of you who are winter weary. We hope the color, green and sunny scenes bolster you through what remains of that cold gray or worse.

     Our morale booster follows below.

 PRIVACY IS A FREEDOM

      It is a hard call, privacy vs investigative reach, but Apple is correct is denying access or a back door into personal information on phones or other devices.

      Privacy is under attack just in the way we live with technology and marketing. The Snowden and Wiki leaks disclosures detail how government is and can snoop. People often forget how willingly they open their lives to surveillance and manipulation via social media, on-line commerce and other transactions.

      We appreciate how difficult is the task of those who work to provide security. Intelligence and law enforcement are challenged by increasingly sophisticated adversaries and the capacity of modern communications. Still we cannot concede an inch of our right to privacy even if it makes investigation, prosecution or intelligence gathering easier. 

      We discovered the excessive reach in the Patriot Act, an emotional response to 9/11. If we give up expectations of privacy and personal rights the bad guys begin to win. It is an objective of terrorists to force democratic governments to behave like fascists or repressive regimes. When that happens we loose.

       Despite the difficulty a democratic republic must value individual rights and liberties. There are many other reasons beyond the philosophical rightness, not the least of which is human incompetence which can and has infected government agencies. There is also the fact that even with good intentions, governments can be used and manipulated by administrations and regimes with less than honorable intentions. Two names to help make that case-Richard Nixon and Watergate cover up. There is also Dick Cheney and his corrupt manipulation in energy and war business. If other less than honorable or zealot driven governments had what the government is pushing Apple for, then what happens to the freedoms we say make us different than dictators, strongmen or others like Stalin, Hitler, Putin, Assad, Isis, and etc.?

       Freedom means just that. Nothing less.

 RAPE AND FOOTBALL

     It's unclear how the Tennessee matter will resolve in the courts but football thuggism and sexual assault continue to plague us. In this most recent case a Tennessee player came to the aid of a rape victim. She had been attacked by two of the man's team mates. Later the good Samaritan was attacked and injured by team mates and when he complained to his coach Butch Jones, Jones berated the man and said "he betrayed his team."

     There is ample documentation of how players are coddled, how aberrant behavior is overlooked, how educational standards are ignored so a football player can compete. It starts in public schools, continues in some colleges and we have all seen how many NFL players are involved in criminal activity, assaults and domestic battery.

     When coaches like Butch Jones are around it's no wonder.

WHO'S LIFE MATTERS? DARK PLAYS

DARK PLAYS

   Street wise and an over comer, Ricky was a friend and a great truck operator. We ate together frequently, shared an appreciation of boxing and worked on deadline to do live television. Ricky's problem was not his.
   He'd come from a neighborhood that required a toughness to simply grow up. His arms bore burn scars from his time  working in a foundry. He began as a studio camera operator. He became an engineer/operator who would "scramble" a microwave unit to the scene. It was a truck full of electronics and television gear. He was fast, smart and enabled the news department to get on the air. That was not a problem.
   Ricky and his wife, a marketing and promotion specialist, lived on the North side, in a suburban community grown from a farm village into homes, condos, apartments, appreciating businesses with a village setting and near mega shopping. Ricky was frequently stopped by the local police.
    As an African-America Ricky was a profile stop.  Though he explained where he lived, worked and produced a car registration, Ricky was stopped repeatedly.  That was an offense to Ricky and to police work and the larger society. 
   Black lives matter.

    I investigated, covered and tangled with racist hate groups for 4 decades-racism close up, urban, rural, north, south and abroad. Many reasons for it. It breeds anger and response.

     All lives matter-not to diminish the inherent and special importance that creates and imbues the mentality and philosophy of Black Lives Matter.  It is not meant to be flip  to say-Of course they do. It is an affirmation only and should  not be construed as anything else.

   How police departments and black citizens interact is a nexus requiring a fix. It is critical. Police officers need  training to help buffer and to see things with a wider sensitivity. Training for state and city police agencies can condition officers to make critical decisions influenced by a better understanding of presenting conditions and a codex of alternative tactics to employ so as to defuse and stop a tragic escalation.

    All training academies and the departments they provide can up their performance. I've reported how local and state academies train, have watched as local police take advanced training at the National Academy and spent 16 weeks following a class of agents through the FBI Academy at Quantico. 

    There are good learning systems, exercises, drills and practical application training that can focus on race, including history and perspectives. I participated in a fire arms training program where my actions and shot placement were captured, analyzed and used in the training. It required a series of critical judgements and action.  After completing a simulation scenario, where you could shoot or be shot in the interactive life like reality, you were grilled by instructors asking what you saw, heard, when and why you made decisions to do what you did and the actions you took, etc.  Its intense and the examination pulses up the heart rate and certainly engages the mind.  It's a good program and such systems can make our local cops better at what they do.

    Lives matter.

     A final thought. Ricky and I often drove to a spot in a near east side neighborhood where they sold deep fried cat fish on white bread with mustard. As the only white man in a place, or even in that part of the neighborhood I was never stopped. It was probably more odd for a white man to be hanging out on that block in that hood than for Ricky to  drive to his apartment.

    The sandwich was world class!

WHAT IS REASONABLE?

     Google Executive Chairman Eric Schmidt opened the window on the tenuous world we inhabit at a Surveillance, Privacy and Civil Liberties conference Friday, but the light he let in captures a multi dimensional web where the map is being improvised as we go along and the perils are grievous.

     Schmidt explained how shocked he was to learn from the Washington Post that his own Google empire was being surveilled by the FBI.  Google now encrypts data between their data centers to protect privacy. Schmidt believes Google to be the safest information purveyor if you wish to avoid surveillance.

     The CATO Institute, a Libertarian think tank, sponsored the first Surveillance conference hosting experts across the disciplines and issues involved in surveillance, privacy and civil liberties. I spent hours at the conference, thanks to  C-SPAN, that special blessing of our information age.

      It appears all of us will move into a time of greater use of encryption. An affect of the Snowden NSA leaks is  everyone now knows a lot more about who is spying and how they are doing it thus the free market response is a series of applications, technology, services and methods of operation to protect privacy.  

     Schmidt observed the rules of this new world are hammered out in a cat and mouse game where governments seek and push Google and the other tech companies who then respond. Legal discussions or suits ensue and become  the process to negotiate a path to established policy. It's all new and the dynamic is ongoing.

     The Google leader said we could almost "end all criminal activity" with greater surveillance but said we should not allow that. Schmidt said even the kind of surveillance used in Britain, facial recognition and other means employed by GC Hq (General Communications Headquarters) is counter to the American way of life. He said we must be careful to protect information privacy.

     Law enforcement has never discovered a surveillance technique it does not like. It gives you pause to learn how many local and state police departments use the FBI developed Stingray technology. That's the system that mimics a wireless cell tower. It's a cell sight simulator that forces all phones in an area to connect with it where it then gathers all of the stored data on a phone.  It can also deny cell service.  Think about it for a moment. The police can turn on a Stingray, which penetrates into your home, car or pocket and makes your phone connect with it where all of your private information is gathered up. How do you think Thomas Jefferson, James Madison, John Adams, George Washington and our other founders would respond to that?

      Don't American's equate privacy with freedom and liberty? We do not tolerate a loss of freedom nor should we which is why we continue to fight over civil rights, gender equality, economic fairness. We remember the Nazis, Joseph Stalin, Pol Pot, Saddam Hussein, et al.  We even intervene in foreign wars to "spread democracy" or "guarantee liberty." How seriously then are we considering implications of our communication practices? Your phone, pad or computer are extensions of your life and often are repositories of your most private or valuable artifacts or information. Don't you have a reasonable expectation to privacy/freedom from surveillance?

      Already batches of metadata have been collected. Algorithmic data analyzers are at work. How long should that information be kept? Washington Post National Technology Reporter Eric Timberg asked Schmidt about what happens in 20 years, or sooner, when he is gone from Google. Schmidt deferred to  Google's founders Larry Page and Sergey Brin saying they share values and a belief in privacy. Schmidt noted they are young men.

      So it seems that a "belief" by young entrepreneur tech capitalists is our firewall. The personal belief of the men and women who have created these marvelous systems and technologies is the wall protecting our privacy and information security? Sorry, being a rich inventor or genius seems a thin credential. Henry Ford, for example, was a notorious anti-Semite. Then of course this is a world with other players, China, North Korea, Russia, Isis, NSA, CIA, GCHQ, FBI, all of whom come with their own idea of privacy, freedom and liberty.

CYBER BOMB THE THIEVES

   Since they've got the data, why not create an algorithmic analysis to interdict and then shut down all of those phishers, scammers, identify thieves and that Kenyan who wants to give you 1.3 million dollars.

   While rounding up and tracking terrorists, the NSA and FBI should find these internet hustlers who steal, extort and are at their best, annoying. Then let the CIA or Cyber Command send a counterstrike that evaporates their illicit program and network, melts their computers and shocks the scammers into the next county. Then maybe Seal Team 6 can capture them and paint a red bulls eye on their forehead.

   Well, at least the first part of that eh?!

LIVE OAK 25

   25 years of Father's Day Weekends at Live Oak Music Festival.

   People who came first as children are now volunteers

 The logo quilt was a hot item in the silent auction.

    Entertainment and grins and just doing your thing.

   Owing to California's wine culture, there are amenities the old festivals may not have had.

   I watched as one of the performing musicians tuned and played the first guitar in the left rack.  She made it sound great.  She ended by smiling and saying, "this thing would make me crazy."

      Later, another of the players had R2D2 sounding pretty good. It would have rocked the Star Wars cantina.

      Those live oaks shelter a lot of great memories and have heard some extraordinary music.
